Terms and Conditions

Please read these Terms of Use carefully before using this Website. By using this Website, you signify your agreement with these Terms of Use. If you do not agree with any of the below Terms of Use, do not use this Website.  Outrun rescue reserves the right, in its sole discretion, to modify, alter or otherwise update these Terms of Use at any time and you agree to be bound by such modifications, alterations or updates.


1. Trade Marks, Copyrights and Restrictions

This Website is controlled and operated by Outrun. All material on this Website, including, but not limited to images, illustrations, audio clips and video clips, is protected by copyrights which are owned and controlled by Outrun or by other parties that have licensed their material to Outrun (“Copyrights”). Material from this Website or from any other Website owned, operated, licensed or controlled by Outrun (“Outrun's Websites”) may not be copied, reproduced, republished, uploaded, posted, transmitted or distributed in any way. Modification of the materials or use of the materials for any other purpose is a violation of the copyrights and other proprietary rights. For purposes of this Terms of Use Agreement, the use of any such material on any other Website or networked computer environment is prohibited.

2. Privacy

  1. Outrun is respectful about the privacy concerns of the visitors to its Websites. As a general policy, no personal information is automatically collected from visitors to its Websites. However, certain non-personal information of visitors is recorded by the standard operation of Outrun’s servers. This information is primarily used to provide an enhanced online experience for the visitor. Information tracked includes the type of browser being used by the visitor, the type of operating system in use by the visitor and the domain name of the visitor’s Internet service provider. Other uses of this information include internal review of the number of visitors to the Websites but only in an aggregate and non-personally identifiable form. This information is used to better understand visitors’ use of our Websites and to support transactions made on the Websites. 3. A Special Note for Parents Concerning Privacy

Outrun makes a special effort to encourage children to consult with their parents before furnishing data. However, Outrun believes that parents should supervise their children’s online activities and consider using parental control tools available from online services and software manufacturers that help provide a kid-friendly online environment. These tools can also prevent children from disclosing online their name, address and other personal information without parental permission.


4. Linked Websites

Outrun, whether or not affiliated with Websites which may be linked to this Website, is not responsible for their content (the “Linked Websites”). The Linked Websites are for your convenience only and you access them at your own risk and in accordance with any policies of the Linked Websites.

5. Disclaimer

The materials in Outrun’s Websites are provided “as is” and without warranties of any kind either express or implied. To the fullest extent permissible pursuant to applicable law, Outrun disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. Outrun does not warrant that the functions contained in the materials will be uninterrupted or error-free, that defects will be corrected, or that Outrun’s Websites or the server that makes them available are free of viruses or other harmful components. Outrun does not warrant or make any representations regarding the use or the results of the use of the materials in Outrun’s Websites in terms of their correctness, accuracy, reliability or otherwise. You (and not Outrun) assume the entire cost of all necessary servicing, repair or correction. Applicable law may not allow the exclusion of implied warranties, so the above exclusion may not apply to you. The material that you read in Outrun’s Websites is provided solely for entertainment and promotional purposes. Any information or opinions expressed in Bulletin Boards, Chat Rooms or other forums conducted on this Website (“Forums”) are not necessarily those of Outrun or its affiliated or related entities or content providers and Outrun makes no representations or warranties regarding that information or those opinions. Furthermore, neither GHS nor its affiliated or related entities or its content providers are responsible or liable to any person or entity whatsoever (including, without limitation, persons who may use or rely on such data/materials or to whom such data/materials may be furnished) for any loss, damage (whether actual, consequential, punitive or otherwise), injury, claim, liability or other cause of any kind or character whatsoever based on or resulting from any information or opinions provided in GHS’s Websites.

6. Submissions

  1. Any notes, message/billboard postings, ideas, suggestions, concepts or other material submitted will become the property of Outrun and Outrun shall be entitled to use the material for any type of use forever including in any media whether now known or hereafter devised. When you submit material to Outrun’s Websites, you agree that Outrun has the right to publish the material for any type of use as outlined above including promotional and advertising purposes.
  2. Outrun is not responsible for any material posted on a Forum. You shall not submit or otherwise publish through such Forums any content which:
    1. libels, defames, invades privacy, or is obscene, pornographic, abusive or threatening;
    2. infringes any intellectual property or other right of any entity or person, including, but not limited to violating anyone’s copyrights or trademarks;
    3. violates any law;
    4. advocates illegal activity; or
    5. advertises or otherwise solicits funds or is a solicitation for goods or services( collectively “Non-Approved Material”).
  3. You agree to indemnify Outrun and its officers, directors, employees, agents, distributors and affiliates from and against any and all third party claims, demands, liabilities, costs or expenses, including reasonable lawyer’s fees, resulting from your breach of any of the foregoing agreements, representations and warranties.

7. E-Mail and Postings Received

Do not post any threatening or libelous e-mails or material on this Website that would be considered a violation of any law. Outrun will fully co-operate with any law enforcement authorities or court order requesting or directing Outrun to disclose the identity of anyone posting any such e-mails or materials.

8. Jurisdictional Issues

  1. Unless otherwise specified, the materials in Outrun’s Websites are presented solely for the purpose of entertainment and promoting programs, films and other products available in Canada and its provinces and territories. This Website is controlled and operated by Outrun from its offices within the Province of Ontario. Outrun makes no representation that materials in Outrun’s Websites are appropriate or available for use in other locations. Those who choose to access this Website from other locations do so on their own initiative and are responsible for compliance with local laws, if and to the extent local laws are applicable.
  2. This agreement shall be governed by, construed and enforced in accordance with the laws of the Province of Ontario, as it is applied to agreements entered into and to be performed entirely within such province. Any action you, any third party or Outrun bring to enforce this agreement or, in connection with, any matters related to this Website shall be brought only in the courts of the Province of Ontario, and you expressly consent to the jurisdiction of said courts. If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions. This is the entire agreement between the parties relating to the matters contained herein and shall not be modified except in writing, signed by Outrun.

USING PERSONAL INFORMATION RESPONSIBLY AND WHERE AND WHY WE COLLECT PERSONAL  INFORMATION


At the Outrun, we understand the importance of individual privacy. We know that earning the trust of our clients and employees is a permanent and ongoing endeavor. With the growth of electronic media it is necessary to take further steps in protecting the privacy of the individual. We fully support the new Canadian legislation, the Personal Information Protection and Electronic Documents Act, “the Privacy Act“, in its role to protect the privacy of the individual. Our role in protecting an individual’s privacy does not stop with this Act. We are continually looking for additional ways to ensure that the personal information we hold is secure accurate and used in a responsible and respectful manner.

As such, we have appointed a manager, who will be responsible for personal information and whose role is to ensure that the personal information entrusted with us is secure and will be used for the purpose intended and not be used for purposes other than what is necessary to offer the service our clients deserve. When you adopt an Outrun animal at our Rehabilitation Center or at one of our foster locations, if you lose or find an animal, participate in one of our microchip clinics or become an Outrun volunteer/foster, there is certain information that we require to serve you better. This information is necessary in order to identify you, contact you, or process your purchase. These pieces of information may include:

  • Name
  • Address
  • Phone number(s)
  • Email address
  • Animal and veterinary information
  • Credit card number and expiration date

To fulfil our animal welfare mandate and to make your experience with animal ownership more positive, we are developing a number of customized services and programs. To do this, we may need more information than you may consider usual.

Here are the main services we currently offer and a description of how the information collected will be used:

Adoption

  • For Outrun to follow up on the adoption, if required
  • For Outrun to confirm sterilization and vaccination of owned animals
  • To register microchip information with EIDAP Canada
  • To send out your adoption shipment from the Royal Cabin company
  • Communication purposes; to send our Outrun alumni events and programs and other printed or electronic updates
  • Statistical analysis for planning and reporting

Animal Surrender

  • For the Outrun to follow up on the surrender and/or animal history, if required
  • Communication purposes; to send our Outrun programs and other printed or electronic updates
  • Statistical analysis for planning and reporting

Lost and Found

  • For the Outrun to follow up on the lost or found report, if required
  • Communication purposes: to send our Outrun programs and other printed or electronic updates
  • Statistical analysis for planning and reporting

Microchip Clinics

  • For the Outrun to follow up on the owner information, if required
  • To register microchip information with EIDAP Canada
  • Communication purposes; to send our Outrun programs and other printed or electronic updates
  • Statistical analysis for planning and reporting

Volunteer

  • For the Outrun to confirm sterilization and vaccination of owned animals (foster volunteers)
  • Communication purposes; to send our Outrun programs and other printed or electronic updates
  • Future solicitations to support our activities and operations
  • All OHS volunteers are also required to provide references and a police record check


PRIVACY PRINCIPLES

Privacy Legislation and the Outrun support the following ten privacy principles:

1. Accountability
The Outrun Director:  will serve as its Chief Privacy Officer.

2. Identifying Purposes
When personal information is collected by the Outrun, the purpose for its collection will be made clear.

3. Consent
The knowledge and consent of customers and clients is required for the collection, use and disclosure of personal information.

4. Limiting Collection
Personal information will only be collected by the Outrun for the purposes that were identified at the time of collection.

5. Limiting Use, Disclosure and Retention
The personal information collected will not be used or disclosed for purposes other than what it was collected. Requests for disclosure of personal information to Third Parties must be accompanied by a completed, signed and dated Authorization to Release Information form.

6. Accuracy
The Outrun will endeavor to ensure that the information it collects is accurate in all regards.

7. Safeguards
Personal information will be protected, by appropriate security safeguards, against loss, theft, unauthorized access, copying etc. including maintaining files in locked drawers and offices, the use of computer passwords, encryption etc.

8. Openness
A full set of policies and procedures relating to privacy and the management of personal information are to be readily available to individuals upon request.

9. Individual Access
Clients or customers of the Outrun who wish to view the records pertaining to them at the Outrun may do so by contacting the Society’s Chief Privacy Officer. Clients or customers may obtain a copy of their record. Clients or customers shall not have access to portions of their file or record that contains information regarding third parties.

A client or customer may provide a written request to the Chief Privacy Officer for correction related to any data contained in their own file or record. Response to an individual’s request should be made within 30 days.

10. Challenging Compliance
Complaints regarding this policy or any privacy issue should be directed to lhodgins@outrunrescue.com.

Upon receipt of a complaint, the Chief Privacy Officer will:

  • Acknowledge receipt of the complaint within 72 hours.
  • Collect the facts through reviewing the relevant record(s) and interviewing any staff members involved.
  • Within 30 days, respond to the complaint describing the action to be taken to correct the situation or the reasons why no action is to be taken. All responses to complaints shall include the following: “If you are dissatisfied with the outcome of this investigation, please contact the Chief Privacy Officer for further review.“
  • Where a request for further review is received, respond within 30 days describing the steps taken in the further review and the steps taken to correct the situation or the reasons why no further action is to be taken. All responses to requests for further review shall include the following, “If you are dissatisfied with the outcome of this review, please contact the Office of the Privacy Commissioner of Canada.“


FUNDRAISING AND DEVELOPMENT

The OHS abides by the Association for Fundraising Professionals’ Donor Bill of Rights.

The Outrun does not sell, rent or trade any donor names.

Outrun customers, clients and donors have the right to be removed from all lists for mail, telephone and other types of solicitation. To have your name removed, please contact us by email at info@outrunrescue.com.
